Teenager Charged with Robbery—Formal Diversion Granted, Robbery Dismissed
This nineteen-year-old client had no record and was charged with robbery. During the incident, he was with several other boys–one of them allegedly pulled a gun while another he allegedly took the complaining witness’ ear pods. Before the incident, the client had begun the process of enlisting in the military. The prosecutor was pursuing the case aggressively and threatened to seek a state prison sentence. Mr. Wright compiled a compelling mitigation package on behalf of the client, which included character letters from teachers and employers, school records, employment records, and proof of his pending military enlistment. After several meetings with the assigned prosecutor and his supervisor, Mr. Wright convinced them to dismiss the robbery, allow him to plead to grand theft, and grant him formal diversion where he will be required to obey all laws and complete community labor. He was able to avoid prison time and a violent felony strike conviction—he will be able to earn a reduction to a misdemeanor if fulfills his obligations.
