Robbery With Prior Strike—Drug Court

The client was charged with robbery, circumstances in aggravation and a prior strike allegation. He had recently been released from prison for a robbery, was on parole at the time he picked up this case. He was facing a second strike and 10 years in state prison. The prosecutor was aggressively pursuing the case and wanted at least four years in prison. Mr. Wright did a comprehensive mental health work-up, which included having a psychiatrist and psychologist evaluate the client. After several meetings with the supervising prosecutor, Mr. Wright was able to get the client into Drug Court where he will have the opportunity to receive the treatment and services he needs, instead of going to prison. If he successfully completes Drug Court, the robbery will be dismissed, and he will be sentenced to summary probation for misdemeanor theft. He will be able to avoid a second-strike, a prison sentence, and a felony conviction.
