Not Guilty of Murder at Trial
Mr. Wright’s client was charged with murder with the use of a firearm and was facing 25 years to life in prison. The shooting occurred in a public place with other people around, was caught on video, and the client was not in lawful possession of the firearm. Mr. Wright convinced the judge to release the client on electronic monitoring with restrictions while the case was pending. The prosecution aggressively pursued the case and made no offer before trial. After a lengthy trial, the jury found the client not guilty of murder. Instead, he was found guilty of the lesser charge of voluntary manslaughter with the use of a firearm, which still carried a maximum sentence of 21 years in prison. Mr. Wright drafted a thorough and persuasive sentencing motion and convinced the judge to impose the lowest possible prison sentence for the charge and gun enhancement respectively. The client was sentenced to just 6 years with credit toward his sentence for all of the time he was out on electronic monitoring.
